By accessing and using PoGoAlerts ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

PoGoAlerts provides a real-time alert and tracking service for Pokémon GO gameplay. The Service includes:

• Real-time spawn notifications for Pokémon
• Interactive map interface
• Discord bot integration for alerts
• Custom filter and alert configuration
• Premium subscription features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You may register using:

• Email address and password
• Discord OAuth authentication

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to terminate or suspend your account at our discretion, without notice, for conduct that we believe:

• Is harmful to other users or the Service

4. Subscriptions and Payments

4.1 Subscription Plans

PoGoAlerts offers paid subscription plans that provide access to premium features. Non-subscribers may have limited access to basic features.

4.2 Billing

Subscription fees are billed in advance on a monthly basis. You authorize us to charge your payment method for all fees owed.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused portions of the Service.

4.4 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users
• Resell or redistribute the Service without authorization
• Share your account credentials with others

6. Intellectual Property

The Service and its original content, features, and functionality are owned by PoGoAlerts and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Pokémon and Pokémon GO are trademarks of Nintendo, The Pokémon Company, and Niantic. PoGoAlerts is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or Niantic.

7. Third-Party Services

The Service may integrate with third-party services such as Discord. Your use of these third-party services is subject to their respective terms and conditions.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or other harmful components
• The results obtained from using the Service will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POGOALERTS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

You agree to indemnify, defend, and hold harmless PoGoAlerts and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
